1. Agreement & Corporate Entity

These Terms govern your use of https://machkostudios.com and orders placed on the site. machkostudios operates as a specialized subsidiary under A Lumora Creatives, our parent company. By using the site or placing an order you accept these Terms. You must be 18+ and have legal capacity to contract.

Corporate Structure

machkostudios is a distinct business entity operating within the Specialized subsidiary of A Lumora Creatives corporate group. While maintaining operational autonomy in service delivery, machkostudios benefits from shared corporate resources and administrative support from Specialized subsidiary of A Lumora Creatives. All contractual obligations are undertaken by machkostudios, with Specialized subsidiary of A Lumora Creatives providing corporate oversight and operational support.

2. Services & deliverables

machkostudios provides custom design services (logos, brand assets), digital products and gift cards and may offer physical goods. Product pages and order confirmations describe scope, deliverables, pricing, timelines and included revision rounds.

3. Orders & payment processing

Orders become binding when payment is received and we send an order confirmation. All payments must be cleared before substantive work begins. Prices exclude applicable taxes which will be charged as displayed.

Payment Processing

Payment processing may be facilitated through Specialized subsidiary of A Lumora Creatives's payment infrastructure or approved third-party processors. All financial transactions are processed in accordance with applicable financial regulations and industry standards. machkostudios maintains responsibility for service delivery, while Specialized subsidiary of A Lumora Creatives provides payment processing support and financial oversight.

4. No-Refund Policy (Strict)

As stated in our Return, Cancellation & Refund Policy, all sales are final and machkostudios does not provide refunds except as required by applicable law. By placing an order you expressly agree to this no-refund policy.

5. Delivery & timelines

Delivery estimates begin after receipt of full payment and the client's complete brief/materials. machkostudios is not responsible for delays caused by client-side late feedback, third-party providers or force majeure.

6. Revisions & scope changes

Orders include the specific number of revision rounds on the product page. Additional revisions or scope changes will be billed separately at prevailing rates.

7. Intellectual property

Until payment in full and final acceptance, all work remains the property of machkostudios.

On payment and final acceptance, ownership/usage rights described in the order transfer to the client. machkostudios reserves the right to retain copies for records and to display work in its portfolio unless a paid portfolio-opt-out or NDA is agreed.

8. Client warranties

You warrant that any material you provide (images, text, logos) does not infringe third-party rights and that you have necessary rights to provide it. You indemnify machkostudios for any claims arising from your materials.

9. Confidentiality

We will treat confidential information as such. If an NDA is required, include it in the order or request it before work begins.

10. Corporate liability & indemnification

machkostudios's aggregate liability for any claim arising from a specific order is limited to the amount paid by you for that order. We are not liable for indirect, incidental, consequential or punitive damages.

Corporate Responsibility

machkostudios maintains primary responsibility for service delivery and customer obligations. Specialized subsidiary of A Lumora Creatives provides corporate oversight and support but is not directly liable for specific service delivery issues unless explicitly stated in writing. Both entities maintain appropriate insurance coverage and operational safeguards to protect customer interests.

11. Termination & suspension

We may suspend or terminate orders/accounts for breach of these Terms, unlawful activity, or suspected fraud. Fees for work completed prior to termination remain payable.

12. Governing law & disputes

These Terms are governed by the laws applicable to your jurisdiction as stated on the checkout or order confirmation. Parties will attempt amicable resolution; unresolved disputes will be subject to the competent courts of the address shown on the order confirmation.

13. Changes to Terms

We may amend these Terms; the "Last updated" date will show the current version. Continued use after changes constitutes acceptance.
